These Terms & Conditions ("Terms") govern your access to and use of TrendMimic, including the TrendMimic website, web application, AI-powered video generation tools, and related services (collectively, the "Service").

By creating an account, accessing the Service, purchasing Credits, or using any part of the Service, you agree to these Terms. If you do not agree with these Terms, please do not use the Service.

1. About TrendMimic

TrendMimic is an AI-powered software service designed to help ecommerce businesses, marketers, creators, and brands analyze short-form video references and create adapted marketing videos using user-provided product information and media assets.

TrendMimic may provide features including:

  • Analysis of reference videos and their creative structures;
  • AI-assisted script adaptation;
  • AI-assisted analysis and matching of user-provided assets;
  • AI-generated voiceovers;
  • Automated video composition and rendering;
  • Subtitle generation;
  • Video and SRT file downloads; and
  • Other related AI-powered video creation features that may be introduced or changed over time.

Features may vary depending on your account, available Credits, and the version of the Service.

2. Eligibility

You must be legally permitted to use the Service under the laws applicable to you.

If you use TrendMimic on behalf of a business or organization, you represent that you have authority to accept these Terms on its behalf.

3. Accounts

Some features require you to create a TrendMimic account.

You are responsible for:

  • Providing accurate account information;
  • Maintaining the security of your account credentials;
  • Keeping your account information reasonably up to date; and
  • All activity that occurs through your account.

You must not share your account credentials with others or use another person's account without authorization.

We may suspend or terminate accounts involved in fraud, abuse, unlawful activity, or material violations of these Terms.

4. Credits

TrendMimic uses Credits as a usage unit for certain video generation services.

Unless otherwise stated at the time of purchase:

  • Credits are purchased on a one-time basis;
  • Credits are not a subscription;
  • Credits do not represent money or stored monetary value;
  • Credits cannot be exchanged for cash;
  • Credits cannot be transferred between accounts;
  • Credits cannot be sold or resold; and
  • Credits are intended solely for use within TrendMimic.

The number of Credits required for a generation may depend on the requested video duration, generation method, processing requirements, or other factors displayed by TrendMimic.

TrendMimic may change its pricing, Credit requirements, available plans, or features in the future. Changes will not retroactively alter Credits that have already been successfully purchased unless required by applicable law.

5. Video Generation and AI Output

TrendMimic uses automated and AI-powered systems to analyze references, process user-provided materials, generate scripts, create voiceovers, and render videos.

AI-generated output may contain errors, inaccuracies, omissions, or unexpected results.

We do not guarantee that generated content will:

  • Be factually accurate;
  • Be suitable for a particular advertising platform;
  • Produce a particular conversion rate or business result;
  • Comply automatically with every platform's advertising or content policies;
  • Match a reference video exactly; or
  • Meet every subjective creative preference.

You are responsible for reviewing generated content before publishing, advertising, distributing, or otherwise using it.

6. Reference Videos and URLs

You may provide a URL to a third-party video or other reference content for analysis.

TrendMimic may process information from the provided reference for the purpose of generating an analysis and creating your requested output.

TrendMimic does not claim ownership of third-party reference content.

You are responsible for ensuring that your use of any third-party reference is lawful and does not violate applicable law, intellectual property rights, platform terms, or other third-party rights.

TrendMimic does not authorize you to download, reproduce, distribute, or otherwise exploit third-party content beyond what is legally permitted.

TrendMimic may retain analysis results derived from reference content for service operation, performance improvement, and reuse of previously analyzed references. Reference video files themselves are not intended to be permanently stored by TrendMimic.

7. User Content

"User Content" means information, text, images, videos, audio, product information, URLs, and other materials that you submit to TrendMimic.

You retain ownership of your User Content.

By submitting User Content, you grant TrendMimic a limited, non-exclusive, worldwide, royalty-free license to host, process, reproduce, transmit, modify as technically necessary, and otherwise use that User Content solely as reasonably necessary to provide, maintain, secure, and improve the Service.

This license ends when the relevant User Content is deleted or when it is no longer reasonably required for the Service, except where retention is required by law or where certain derived information has been retained in accordance with our Privacy Policy.

8. Your Responsibility for User Content

You represent and warrant that:

  • You own or have sufficient rights and permissions to use the User Content you upload;
  • Your User Content does not knowingly infringe another person's intellectual property, privacy, publicity, or other rights;
  • You have obtained any required permissions for people appearing in uploaded media;
  • Your use of User Content complies with applicable laws and third-party platform rules; and
  • You will not use TrendMimic to create unlawful, fraudulent, deceptive, or harmful content.

You are solely responsible for the User Content you submit and the content you publish using TrendMimic.

9. Prohibited Uses

You may not use TrendMimic to:

  • Violate any applicable law or regulation;
  • Infringe intellectual property, privacy, publicity, or other rights;
  • Create or distribute fraudulent or deceptive advertising;
  • Impersonate another person or organization in a misleading manner;
  • Upload malicious software or harmful code;
  • Attempt to gain unauthorized access to TrendMimic or its infrastructure;
  • Interfere with or disrupt the Service;
  • Circumvent usage limits, Credits, authentication, or security controls;
  • Reverse engineer or attempt to extract the underlying source code or proprietary systems, except where such restriction is prohibited by applicable law;
  • Resell or commercially redistribute access to TrendMimic without our written authorization; or
  • Use the Service in a manner that could reasonably cause harm to TrendMimic, its users, third-party providers, or the public.

We may suspend or terminate access where we reasonably believe the Service is being used in violation of these Terms.

10. Commercial Use

Subject to these Terms and your applicable plan or purchase, you may use videos generated by TrendMimic for lawful commercial purposes.

You remain responsible for ensuring that your final content complies with the rules, advertising policies, copyright requirements, disclosure requirements, and other requirements of the platform on which you publish it.

11. Third-Party Services

TrendMimic may rely on third-party services to provide certain functionality, including hosting, storage, analytics, AI processing, text-to-speech, payment processing, and other infrastructure.

Third-party services may have their own terms and policies. TrendMimic is not responsible for independent failures, outages, policy changes, or actions of third-party providers outside our reasonable control.

12. Payments

Payments for TrendMimic products may be processed by Paddle.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment transactions are subject to the applicable terms and policies of Paddle and the payment methods made available during checkout.

Prices displayed on the TrendMimic website are in the currency shown at checkout unless otherwise stated.

13. Refunds

Refunds are governed by our Refund Policy and applicable law.

Because TrendMimic provides digital services and Credits, refund eligibility may depend on applicable consumer protection laws, the status of the purchased Credits, and Paddle's applicable refund procedures.

14. Intellectual Property

The TrendMimic website, software, interface, branding, logos, designs, documentation, and underlying technology are owned by or licensed to TrendMimic and are protected by applicable intellectual property laws.

Except for the rights expressly granted in these Terms, no rights are transferred to you.

You may not copy, reproduce, distribute, modify, sell, lease, sublicense, or create derivative works from TrendMimic's proprietary software or branding without appropriate authorization.

15. Feedback

If you provide suggestions, ideas, or feedback regarding TrendMimic, you agree that we may use such feedback without restriction or compensation to you, provided that we do not disclose confidential information you separately identify as confidential.

16. Service Availability

We aim to provide a reliable service, but TrendMimic is provided on an "as available" basis.

We do not guarantee that:

  • The Service will always be available;
  • Video generation will always complete successfully;
  • Processing times will always remain within a particular period;
  • Third-party AI or infrastructure services will always be available;
  • The Service will be free of errors; or
  • Every feature will remain available indefinitely.

We may modify, suspend, replace, or discontinue features when reasonably necessary.

17. Account Suspension and Termination

You may stop using TrendMimic at any time.

We may suspend or terminate your account if:

  • You materially violate these Terms;
  • You engage in fraud or abuse;
  • You use the Service unlawfully;
  • You attempt to circumvent security or Credit controls; or
  • Your continued use creates a significant risk to TrendMimic or other users.

Where reasonably appropriate, we may provide notice before termination.

Termination does not eliminate obligations that by their nature should continue, including provisions relating to intellectual property, liability, payment obligations, and dispute-related matters.

18. Disclaimer

To the maximum extent permitted by applicable law, TrendMimic is provided without warranties of any kind, whether express, implied, or statutory, except where such warranties cannot legally be excluded.

We do not guarantee that the Service or generated content will achieve any particular commercial, advertising, marketing, sales, or financial result.

You are responsible for evaluating and reviewing generated content before using it.

19. Limitation of Liability

To the maximum extent permitted by applicable law, TrendMimic and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, business opportunities, or goodwill arising from your use of the Service.

To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to the Service will not exceed the amount you paid to TrendMimic for the Service during the twelve months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

20. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless TrendMimic and its operator from claims, liabilities, damages, losses, and expenses arising from:

  • Your User Content;
  • Your violation of these Terms;
  • Your unlawful use of the Service; or
  • Your infringement of third-party rights.

21. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may update the "Last Updated" date and, where reasonably appropriate, provide additional notice.

Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms, subject to applicable law.

22. Governing Law

These Terms will be governed by the laws applicable to the operator of TrendMimic, except to the extent mandatory consumer protection laws in your jurisdiction provide otherwise.

Nothing in these Terms is intended to remove or restrict mandatory rights that you may have under applicable law.
